Mediation is a way of resolving disputes without we need to go to court - and can be a very effective way of settling disputes where court proceedings have already been started.
It provides a means by which the sometimes high cost of court proceedings can be avoided, and enables parties, if they wish, to conclude disputes in ways that cannot be ordered by a court.
It is a very flexible procedure with the parties retain ultimate control over the process, but a skilled mediator can often assist entrenched parties in what may otherwise appear to be an irreconcilable dispute, to achieve a settlement that is satisfactory to all concerned.
David Goldberg is an accredited CEDR (Centre for Effective Dispute Resolution) mediator and has over 25 years’ experience as a dispute resolution solicitor.
